Original Air Date: November 22, 2023 For some, success can be a long road, and for others, it can happen overnight. The quality that both these people have in common is staying true to who they are, no matter how long it takes. Jefferson Fisher is a board-certified Texas trial lawyer and founder of Fisher Firm, which has over 6 million followers on social media. He enjoys teaching people to persuade and communicate effectively in high-conflict situations. “I help people argue less so they can talk more.” On this week's episode, Maria sits down with Jefferson to discuss gaining millions of followers overnight, tips on genuine communication, his upcoming book, running his law firm, and his love of peanut M&Ms. Key Takeaways Take a step back. Take a pause before responding to someone else’s aggression. Maybe they’re having a bad day and it’s not about you. Don’t overthink it. Sometimes it’s better to get things done than to be a perfectionist. Don’t let it keep you from moving forward. Share your passion. Chances are someone else is passionate about the same thing you are. Put yourself out there, and you’ll probably be rewarded. It’s hard to run a law firm. So much is asked of you, and you have only so much time to accomplish it all. Maybe you don’t always know the answers, but you’re afraid to show weakness. How do you delegate and trust people to get the job done right? J.L. King has the answers. J.L. King, II, is an experienced civil trial lawyer in Georgia. He primarily represents catastrophically injured victims and the families of individuals who have died as a result of negligence. Before he chose this focus, J.L. worked for one of the premier insurance defense firms in the southeastern United States. On this week’s episode, Maria speaks with J.L. about his small-town upbringing, how you can be a good lawyer and a good marketer, being a good delegator, why things don’t always have to be perfect, and the ins and outs of managing your staff. Key Takeaways You can’t be the best at everything. Recognize your limitations. Even the most successful people have things they aren’t good at. They accept it and learn where to put their focus to best benefit the company. There’s no shame in asking for help. Consider part-time employees. Staffing can be highly stressful. Hiring, firing, and questions about overstaffing and understaffing can all be overwhelming. Consider hiring someone part-time who can fill a gap or jump between departments when needed. They can be a help at the most stressful moments. Delegate. Delegate. Delegate. Hire people that complement your weaknesses. Not good at marketing? Hire a marketing manager. Not good at writing? Hire a copywriter. Trust those people with their tasks, and don’t micromanage. This kind of trust can take a lot of weight off your shoulders. On this week’s episode, Maria speaks with Taylor about fashion in the workplace, working with her family, being a legacy, and finding her niche in fighting for victims of abuse. Key Takeaways Be smart about fashion. Yes, it is possible to dress appropriately for the workplace and still feel confident about your looks. Taylor teaches us that you don’t have to shop high end to feel high end. Search and you can find great deals at places like Target, Nordstrom Rack, and Saks OFF Fifth. And remember, tailor, tailor, tailor. Don’t squander your privilege. Take every opportunity and leg up that life gives you. Use it to do good, and don’t throw it away. There are tons of people who would give anything to be in your position. Don’t let them down. Find your niche. Sometimes, you have to work to find your calling because it’s not immediately apparent. Are mass torts something you're interested in, but haven’t had the time to learn the ins and outs of? Maybe you’re already acquainted, but just need some advice on how to move forward. Either way you’re going to come out of this podcast with everything you need to know about mass torts. As CEO of The Search Engine Guys (TSEG), Chris Massaro oversees the company’s growth in its operations and sales, as well as managing key accounts for single-event and mass tort law firms. TSEG is a legal marketing company that has expert knowledge in mass tort advertising. On this week's episode, Maria sits down with Chris to discuss mass torts. What are they? How do you advertise? Why should you invest? How do you invest? How do you protect your money? And how do you avoid unscrupulous offers? They also discuss the unusual way Chris got into marketing and why social media hates lawyers. Key Takeaways Don’t call out sick from Dave & Busters. If Chris Massaro had called in sick that day, he may have never found success in his current career path. You never know when fortune might strike, so try to take advantage of every opportunity presented. Most importantly, make sure to be honest about your hangover. Encourage your employees’ success. Find joy in your employees’ accomplishments. Think about how each business decision affects not only you, but also your staff. Closing that next lead means more money for the business, which allows you to pay higher salaries, which leads to an employee closing on their first home. Think twice before you decide to go home early and skip that call. Be smart about your investment. Mass torts can be profitable, but only with the right guidance. Beware of scams and people just trying to make a quick buck. Do your research, and make sure to vet the people you work with. Don’t let yourself fall victim to the wrong person. Having tons of energy can be a great thing if you know how to put it to use. Say yes to new opportunities, make light of yourself on TikTok, buy a new Rolls-Royce, or even build your own private courthouse. How are these all related? Kevin Kennedy did them, and they all, in one way or another, led to the growth of a successful law firm. Kevin Kennedy is the founder of The Kennedy Law Firm in Clarksville, Tennessee. They are a Christian law firm that provides counsel for everything from personal injury to estate planning. His family has lived in Clarksville since just after the Revolutionary War, and he has recently surpassed 1.6 million followers on TikTok. On this week's episode, Maria sits down with Kev to discuss gaining a huge TikTok following, saying yes to opportunity, hiring A players, Elvis, and being on Oprah. If you listen long enough, you also may find out what it’s like to be serenaded by Kevin. Key Takeaways Have a core value system. Kevin Kennedy lets his Christian values guide him in his everyday life. They are reflected in his personal and business decisions. Whether it’s religion or your own personal values, have a touchstone you can go back to when you're struggling and need help. Don’t say no. Should you say no to purchasing a Rolls-Royce? Probably not. Kevin Kennedy didn’t, and that Rolls got him a case that covered his purchase in just ninety days. Maybe you don’t need a Rolls-Royce, but try taking a chance on something that may not make sense at the time, because you never know what it may lead to down the road. Don’t burn bridges. It’s never a good idea to burn a bridge, no matter how good you think it will feel. Down the line, you may run into the person you collided with in a situation where they have all the cards. Lawrence LeBrocq uses $100 bills to motivate his staff. Try to find what works best for you. Go all out for your clients. You may have a client who suffered a horrific accident that no amount of money can fix, but money can ease their pain. Putting in the extra effort can lead to a much bigger verdict. You may be surprised at what they can accomplish without you. “At the heart of it all, I’m a person who wants to empower others to take control of their lives and future.” Jennifer Gore-Cuthbert is the founding attorney and owner of Atlanta Personal Injury Law Group. She represents victims of vehicle collisions, drunk driving collisions, those injured in a slip-and-fall, and wrongful death cases. Jennifer’s goals of becoming an attorney and opening her own practice were shaped by her own personal injury experiences. In college, she was seriously hurt in a car accident. After going through the arduous recovery process and having to navigate her own legal case, Jennifer decided that she wanted to dedicate her professional life to helping other victims get back on track. On this week's episode, Maria sits down with Jennifer to discuss building a large following on social media, teaching leadership skills, giving your team autonomy to make decisions and Jenn secret shops her own firm. Creating an authentic brand around your business can have a big impact on the growth of your firm. Don’t be afraid to step out of your comfort zone. As a Miami native, attorney Amanda Demanda stands up to big insurance companies and businesses in pursuit of justice. She focuses her practice specifically on representing people injured due to the negligence or unsafe practices of others. Amanda firmly believes that products, places, and health care are made safer through lawsuits that shed light upon unsafe products and practices. On this week's episode, Maria sits down with Amanda to discuss creating a stand-out brand, not being afraid to break norms, diversifying marketing, and working with the Spanish and elder communities. Key Takeaways Your professional brand doesn’t have to be your personal brand. Everyone associates Amanda Demanda with her pink brand, but it’s not her favorite color. She picked a color she knew would stand out in the space. What works for your brand will be different than what works for you personally. Do some market research before making a decision. Diversify your marketing efforts. Don’t just focus on one form of advertising. There are many forms of both digital and print marketing. Amanda’s Instagram was deleted through no fault of her own. If that had been her only platform, she would have been in a lot of trouble. Don’t fall into that trap. Know your demographics. Having the odds stacked against you doesn’t mean giving up. Finding your path may be tough, but with hard work and determination, the possibilities are endless. Gary has held the record for the highest jury verdicts in numerous courthouses, including a staggering $125 million-dollar jury verdict in Ventura County in 2016. He went directly from high school to law school, never attending college. He put himself through a four-year night program while working at a law office, where he started as a file room clerk. Immediately after passing the bar, Mr. Dordick opened his own law firm, starting out with no employees. Now, Dordick Law Corporation has three locations, fifty-six employees, and eighteen lawyers, including his three kids, Michelle, Dylan, and Taylor, as associate lawyers. On this week's episode, Maria sits down with Gary Dordick as they discuss what it means to be healthy at 60, how he found his path through martial arts, working with his kids, and how he sees the future of law. Key takeaways College isn’t everything. Not going to college doesn’t mean not being successful. Carve your own path, learn from others, and take advantage of every opportunity. Don’t spoil your kids. Even though you may want to give them everything you didn’t have, it’s ok to hold some things back. Life isn’t perfect. Things get in the way. Issues arise. Problems come up. Don’t let that dissuade you from following your dreams. As a trial attorney in Baltimore, Joe Volta focuses his practice on complex product liability litigation. Additionally, he works with clients to handle a variety of cases that include general business concerns, auto and motorcycle negligence, wrongful death, truck accidents, and premises liability. On this week's episode, Maria sits down with Joe at the MTMP Conference in Las Vegas. They discuss when it’s time to start your own firm, struggling with addiction, and showing vulnerability on social platforms. Key takeaways Take the leap and start your own firm. Sometimes the best way to move forward is to take big chances. Joe turned down a great opportunity in order to take a risk and follow his passion. There may be a long road ahead, but his hard work has paid off. Addiction can be overcome. Don’t be afraid to seek help. A lot of people are dealing with similar circumstances. Attorney Ed Ciarimboli concentrates his practice on trucking and auto collision and medical malpractice litigation. Ed began the Safe Prom Pledge in 2010 to promote a drug-free and alcohol-free prom night for students throughout Eastern Pennsylvania. To date, they have spoken to more than 25,000 high school students about the dangers of driving under the influence of drugs and alcohol. As of this podcast’s release he has also completed acquisition of three outside law firms and is working on a fourth. On this week's episode, Maria sits down with Ed at the MTMP conference in Las Vegas. They discuss the benefits of offline advertising, how a couple magnets turned into a lot of business, why juggling got Ed 20,000 views on social media, and the best ways to sell or acquire a law firm. Key takeaways You never know where your next lead may come from. Be open to new marketing opportunities. Whether it’s television, billboards, social media, SEO, conferences or charity events, always be networking, and be on the lookout for new connections. Always plan your exit strategy. Don’t wake up one day at 75 and realize you have no way out. Build your business to be sellable or have a plan for succession. Why put all that hard work to waste because you didn’t think ahead? Don’t let screens mesmerize your kids. A bit of time on the tablet is ok, but don’t let it consume their life. Encourage reading and outdoor activities. They’ll thank you when they’re older. Growing a business is hard, especially when you start out with nothing. People may or may not be out to get you, and your health may be in a questionable state. But don’t worry; it can all be overcome. Michael Mogill began Crisp in 2012 with $500 to his name. What started as a video production company for law firms has transformed into a multi-million dollar corporation with services spanning everything from executive coaching to AI auto-attendants. On this week's episode, Maria sits down with Michael at Crisp headquarters and talks about how optimizing your health can lead to business success, what it’s like having his wife as his business partner, why you should create a succession plan, confronting your critics, and planning an $8 million conference. Key takeaways Make friends, not competitors. Turn them into allies. Sharing your knowledge can lead to greater success for you both. Promote your team. A business is run by a team of many. Show your employees appreciation by showcasing them to your clients. This will lead to a healthier company and greater outcomes. Optimize your health. Your health isn’t just how you look or feel. Traumatic brain injury (TBI), one of Jay’s areas of expertise, is a leading cause of death and disability among children and young adults in the United States. Each year an estimated 1.5 million Americans sustain a TBI. Jay Vaughn has made a career out of helping TBI victims. He is one of the first attorneys to be board certified in truck accident law by the National Board of Trial Advocacy. Since 2013, he has been named to the Kentucky Super Lawyers, which recognizes only 5 percent of attorneys in Kentucky. Jay understands that his clients have had their lives turned upside down and works tirelessly to achieve justice for them. On this week's episode, Jay goes in depth on what it’s like working with clients living with TBIs. We talk about why it can be so hard for them to find justice and what you can do to educate others about this condition. And we discuss billboard marketing and whether advertising really works. Key takeaways Brain injuries are not always obvious. Just because someone isn’t falling over or slurring their speech, doesn’t mean they are ok. Many symptoms of mild brain injury hide under the surface and without treatment can lead to long term repercussions. It’s ok to have a billboard. Many lawyers see billboards as beneath them, but not everyone agrees. In 2022 over 6.2 billion was spent on billboard advertising. All those people can’t be wrong. Can they? Do what you can to educate others. Many people stay uneducated when it comes to recognizing TBI symptoms. Take a moment to pass along some of the knowledge you gained from this podcast. English law, monastery living, and university court cases. That sounds like enough topics for three podcasts, but for seasoned litigator and world traveler Andre Regard, it’s just one. Join us as Andre gives us insight into his worldly life. Andre Regard is a litigator and business transactions attorney. He has prevailed in complex business cases for clients in both state and federal courts. Andre grew up in Louisiana and served in the Navy for eight years as a Supply Corps officer. He has also been an active thoroughbred horse owner and breeder since 1996. On this week's episode, learn what it’s like to practice law in England, about a barrister vs. a lawyer, how to not say a word in a monastery (and not have a cell phone!), and why going to court against a university can get very complicated. Listen as Andre Regard gives you a lesson on history, spirituality, and justice all in one! Key takeaways English law is not unlike the military. Being a military man and English law aficionado, Andre couldn’t help but notice the similarities between both. Unlike American law, the American military and the English judicial system is a top-down affair. You don’t have to be a monk to find inner peace. Andre Regard has taken the time to find his spirituality on semi-annual trips to the monastery, but you don’t have to take a trip to find peace. Find little things throughout the day to calm your mind. Fight for what you believe in. Unable to just sit and watch as universities cheated students out of their money, Andre took the universities on and won. Follow in his footsteps and stand up for your beliefs. Don’t worry, it doesn’t have to be a precedent-setting court case. For some, running one company is enough. Try running five or six. This week we sit down with lawyer, entrepreneur, game show contestant, Dungeons and Dragons princess, Law-Di-Gras extraordinaire, and twin, Bob Simon. Robert T. Simon is a co-founder of the Simon Law Group — aka Justice Team — and acts as the primary trial attorney. He also co-founded Justice HQ, a fast-growing, collaborative workspace and network aimed at helping lawyers break away from the stodgy firms of old to grow their own solo practices. On this week's episode, sit back and relax as Bob tells us why you shouldn't wear suits. He teaches us how to be a giver, not a taker; the correct way to read Green Eggs and Ham; and what not to do while working as a teen at your community pool. If you listen closely you may even learn how to masquerade as a secret princess while playing Dungeons and Dragons. Key takeaways Be a giver, not a taker. Networking is hard, and there has to be a give and take. Don’t create a relationship that’s lopsided. Always try to give as much as you receive. It can be as simple as a "Thank you" or sharing some knowledge. Even lawyers can have a good time. Whether it’s attending Law-Di-Gras or playing Dungeons & Dragons, Bob makes time for fun. Take the time to find the joy in your life. You don’t always need a suit. Bob may recommend flip-flops at a conference, but not everyone can be that zen. Next time you go to grab that suit, maybe try business casual. It could change your whole outlook on life. To contact Bob Simon, DM @planetfunbob on Instagram. Just make sure you’re not a bot. Many law firms, both new and old, put intake at the end of their to-do list. They make the classic mistake of not putting customer service first. Learn from Mark Anderson why intake should be one of your top priorities and the right way to go about it. Personal injury attorney Mark Anderson is one of the most recognized attorneys in the Dallas-Fort Worth Metropolitan Area. For more than twenty years, he has helped injury victims obtain fair and just compensation from big insurance companies. This week Mark tells us how being fanatical about intake helped him grow to over 20,000 clients and gives practical tips on how other law firms can follow in his footsteps. We learn the mistakes he made along the way, how Spanish clients impact his workflow, and a bit about his famous fiancée. Key takeaways Great intake equals greater customer growth. Prioritize your intake from the very beginning. An amazing experience for your clients leads to an increase in closed cases. Spend the time to train your employees correctly and follow up on that training. It's not a one-and-done deal. Put in the work to make your Spanish-speaking clients happy. Mark removes friction by only hiring bilingual employees for his intake team. Learn about the differences between cultures and how to be sympathetic to their needs. Everyone has the right to representation. Create a work-life balance. Mark tells us how it's possible to run a successful law firm and to stop and smell the roses as well. He talks about traveling the world, gaining a business coach, and learning to put trust in your employees to watch over the business while you're gone. If you want to run a successful firm, one of the most important skills you can have is being able to adapt. The COVID-19 pandemic forced many law firms to rapidly adjust to new work procedures, including everything from remote workers to digital case management. And even now, in the aftermath of the pandemic, Chad Dudley is focused on staying on the cutting edge of firm management. Chad Dudley's law firm, Dudley DeBosier Injury Lawyers, employs more than 50 attorneys and 170 employees across the state of Louisiana. He also spent nearly ten years helping other plaintiff personal injury law firms run more efficiently through his company Vista Consulting. In 2017, Chad joined CJ Advertising's team, where he now serves as their CEO, helping personal injury firms optimize their marketing efforts. This week, we sit down with Chad to discuss how his firm is adapting to a post-COVID world. Chad emphasizes the importance of building effective attorney teams and having a dedicated HR manager. He also highlights the need for law firms to adapt to changes in lead generation and focus on acquiring qualified leads at a reasonable cost. Key Takeaways Focus on your foundation. Building a successful firm requires consistently practicing simple disciplines at an extreme level. From effective team-building to efficient lead generation, good habits need to be baked into the DNA of your firm. Gather qualified leads. Chad stresses the significance of lead generation strategies that focus on acquiring qualified leads. He recommends maintaining a healthy ratio of qualified leads to signed cases, illustrating how this approach enhances a law firm's success. Invest in HR management. One of the keys to staying on the leading edge of your market is assembling a strong team. Having a dedicated HR person for hiring can ensure that you've got the right talent contributing to your firm's growth. Often, crafting a solid demand letter is critical to getting a fair settlement for your clients. But writing demand letters is a time-consuming process, and managing it in-house can limit your ability to grow your law firm. EvenUp is a software company dedicated to helping law firms of all sizes streamline their demand process and get better results for their clients. Raymond Mieszaniec, COO of EvenUp, knows first-hand the sort of impact that a lowball settlement can have on a victim’s family. His passion for leveling the playing field for personal injury lawyers and accident victims has helped him grow EvenUp into a thriving business in just three years. Today, we sit down with Raymond to talk about how EvenUp got started and how it’s helping law firms scale their demand process without compromising quality. Learn what goes into crafting a strong demand and how AI is changing this aspect of the PI field. Key takeaways EvenUp helps any size law firm streamline their demand process. From sole proprietors who may only need to write six demand letters a year to high-volume firms generating 200 demands a month, EvenUp can help any size firm create a more streamlined demand process. Better demands result in a better future for clients. Ray’s personal story shows that low settlement offers can impact an accident victim and their family for generations. EvenUp’s services can help lawyers get the best results for their clients, which may result in a better future for them and their loved ones. Vulnerability is important when crafting a good demand. Although many accident victims may tend to hide their pain, that can be counterproductive when creating a demand. Discovery is one of the most tedious parts of the personal injury litigation process. You and your staff may spend as long as ten hours working on discovery for just one case. But what would you say if we told you there’s a way you can cut that time down to just two hours? That’s exactly what Pratik Shah and Esquire Tek are doing for their clients. In addition to being a co-founder and CEO of Esquire Tek, Pratik is the associate director of litigation at Panish | Shea | Boyle | Ravipudi LLP. In 2021, he was named one of the Top 15 Attorneys Disrupting the Legal Industry, and he’s been named a Super Lawyers Rising Star multiple times. This week, we talk to Pratik about how Esquire Tek works and how it can help attorneys streamline their discovery process and better scale their operations. We also discuss how artificial intelligence is already changing the PI space and what changes we might expect to see in the future. Discover Maria and Pratik’s thoughts on using Chat GPT for advice on your love life on this episode of the Tip the Scales podcast! Our listeners will get an exclusive discount waiving the $295 activation fee when they sign up for Esquire Tek. Use code LAWRANK when you register at https://www.esquiretek.com/ Key Takeaways: Esquire Tek can make the discovery process much easier. Using AI, the company can cut down the average time of discovery for a case from ten hours to two hours. Pratik and his team are also dedicated to making sure that their software is really useful to every one of their clients. AI is already transforming the legal space. Companies like Esquire Tek and EvenUp are already utilizing this technology to make life easier for lawyers, and many other companies are working on similar software. But far from killing the legal industry, Pratik believes AI can free up lawyers’ time to expand the cases they take on. While AI can be a powerful asset, you do have to be careful with it. Programs like Chat GPT have clauses specifying that the information you give them will be stored and use to train the programs. You need to limit how you use the program to ensure that you aren’t compromising client confidentiality. Crunch the Numbers: Using Big Data to Achieve Better Verdicts Too often, lawyers use guesswork to make decisions in cases worth tens of millions of dollars. And while gut feelings can be powerful, what if you could make decisions based on hard data instead? That’s exactly what John Campbell is helping lawyers do every day. John has come up with an innovative method of using scientific survey techniques to predict outcomes of jury trials. His studies can tell you whether you’re likely to win or lose a case, how much compensation you’re likely to get from a jury, and even how you should structure your case to get the best verdict. John developed this technique during his tenure as a professor at the University of Denver Sturm College of Law, and to date, he’s helped lawyers recover nearly $2 billion in trial. This week, John walks us through how his system works and the amazing results they’ve seen. Learn how your firm can start making better-informed decisions in trial, from jury selection to your closing argument. Key takeaways Big data can help you get better verdicts. John’s system has proven to be incredibly accurate at predicting what a jury will award in a case. Not only can you make sure you’re not asking so much that the jury will vote against you, but you can make sure you’re not leaving any money on the table. The earlier you start studying the case, the more options you have. If you call John in two weeks before trial, he can perform a study, but you’ll be limited in the changes you can make to get the best result. If you call him in early, he can help you shape your case to get the best possible outcome. Creating empathy with the jury is key. Using techniques like “the man in the black suit” can help jurors start to put themselves in the plaintiff’s shoes. This may make them more likely to return a larger settlement for your client. Winning big verdicts at trial takes more than just having the facts in order. As a lawyer, you need to be at your best, ready to pivot to meet any new challenge as it arises. You are your clients’ champion, and you need to be battle-ready as soon as you step into the courtroom. Kurt Zaner’s strict health regimen has helped him achieve some truly groundbreaking results for his clients. He secured the biggest premises liability verdict in the history of Colorado, and in 2017, he was recognized for getting two of the biggest verdicts of the year across all practice areas. Kurt has been named one of the Top 100 Trial Lawyers, Super Lawyers, Super Lawyers Rising Stars, and Top 3 Best Rated Denver Injury Lawyers. This week, Kurt digs into the health routine he uses while he’s in trial to stay at his sharpest. We talk about some of his biggest verdicts and the Hollywood-worthy maneuvers that helped him win those cases. Discover the lessons Game of Thrones can teach us as trial lawyers and learn why you should consider taking an acting class on this week’s episode of Tip the Scales. Key takeaways: Find the routines that keep you at your best. Kurt uses a combination of cold plunging, breathing techniques, and clean eating to keep him sharp during trial. Taking care of yourself can help you be on top of your game and get better results for your clients. Be a champion for your clients. As a lawyer, your job is often to fight for those who can’t fight for themselves. Remembering that responsibility can change how you approach cases, both in and out of the courtroom. Be authentically yourself. It can be easy to feel like you have to step into the role of “lawyer” as soon as you get in front of a jury. So many of us go through life every day feeling like we have little control over what happens to us. Planes get delayed, kids get sick, and we find ourselves frustrated, stressed, and generally unhappy. And while we may not be able to stop travel delays or illnesses, Joe Fried believes that we do have control over how we respond to these situations. Joe has been challenging his preconceived notions about how the world works and how we should respond to the people we encounter every day. Not only has this helped him to become calmer and happier in his personal life, but he is also bringing these ideas to his work in the courtroom. Joe is among the top truck accident lawyers in the country, and has, in fact, been named Trucking Trial Lawyer of the Year. This week, we’re delighted to welcome Joe back to the podcast to talk about how the work he’s doing in his personal life translates to his success in trial. We reexamine the assumptions we make every day, discuss the power of empathy, and dig into the work Joe is doing to help empower women in the legal field. Key Takeaways Everything works out okay in the end. Even things that may be painful or frightening in the moment will eventually become something you can move past and accept as part of your path. Spending time worrying about whether something will work out okay is just wasted energy. You can control your beliefs and outlook on the world. Many of us feel like we don’t have any control over the things that shape the way we view the world. But you can make a conscious choice to change your preconceptions and shift how you view a situation. Being a good lawyer doesn’t always mean being tough. Oftentimes, lawyers — especially women — feel like they have to present a front of being tough, badass, and no-nonsense. But being empathetic, vulnerable, and even emotional in front of a jury can sometimes help you get a better result for your client. Sean has since built a successful career and now shares his skills and advice with newer lawyers. Sean is the founder of Claggett & Sykes Law Firm, which has recovered over $300 million for their clients. In 2017, the Nevada Justice Association named him Trial Lawyer of the Year. He was also named a Mountain States Super Lawyer every year from 2014 to 2022. In addition to his work at Claggett & Sykes, Sean is an adjunct professor at UNLV’s William S. Boyd School of Law. He talks to us about the role music plays in helping him connect with juries. And we dive into parenting and how Sean is raising two remarkable kids. Key Takeaways Prioritize your health. Sean survived a near-death experience that helped him shift his perspective on life and law. Learning to recognize signs of burnout and make time for recovery can help you avoid a similar lesson. Trust your skills. When you’re first starting out, you may feel like you just got lucky on a case or that you’re a one-hit-wonder. Don’t let imposter syndrome ruin your confidence; instead, stay the course and let your work speak for itself. Find the emotional connection. Building a brand is hard work. From choosing a market segment and a name to finding marketing opportunities that you can afford, it takes a lot of time, effort, and money. And it can be even more challenging when you’re trying to break into a market as competitive as Las Vegas. Justin Watkins of Battle Born Injury Lawyers has seen his marketing efforts return remarkable profits. Battle Born Injury Lawyers has recovered over $100 million for their clients, including several individual verdicts well over $1 million. Justin has been named one of southern Nevada’s Top 150 lawyer every year for nine years running, and in 2016, he was elected to the Nevada Assembly. This week, Justin sits down with us to talk about how he started Battle Born Injury Lawyers and how he uses a variety of marketing channels to maximize his ROI. We also discuss the death of his friend and business partner, Troy Atkinson. Key takeaways Diversify your marketing. Billboards, radio ads, TV ads, SEO, and social media can all work together to get you more conversions and a higher ROI. A potential customer may drive by your billboard, see an ad on social media, and then recognize your name when it comes up in their search for a lawyer and decide to give you a call instead of your competitor. Don’t be afraid to make changes in your firm. As your marketing begins to work, you may find that the systems you have in place don’t meet your needs with the larger volume of calls you’re receiving. Be willing to scrap the systems that don’t work for you any more, and set up scalable processes that can sustain this new level of growth. Be grateful for every day. Justin’s business partner, Troy Atkinson, lost his life to colon cancer in 2016, but right to the end, he fought for every day he had. As you grow your legal practice, it can be tempting to focus in on one specific area. And while diving deep into a specialty can be good, it’s important to remember not to limit yourself. Referrals can be one of your best friends, both in getting new cases and in expanding the scope of your practice. Jeremy Tissot of The Tissot Law Firm is a pro at both referring cases to attorneys who specialize in other areas of law and handling cases that get referred to his firm. He has become one of the leading experts on litigating traumatic brain injury cases, and in fact, is a faculty member and featured speaker at TBI MedLegal conferences. Jeremy has taken more than 2,000 depositions over the course of his career and has been first chair on over thirty jury trials. Today, we talk about when you should refer a case to another lawyer and how to make sure your intake team is set up to accept cases that get referred to you. Jeremy shares his insight into working with TBI victims, including the challenges working with mentally ill clients can pose. Key takeaways Learn what you don’t know. No matter how long you’ve been working in a field, there’s always more to learn. You can’t get complacent and start to think you have everything figured out. Always be looking for what you don’t know, and don’t be afraid to call other lawyers for help. Focus on improving your intake. If you’re missing more than 10 percent or so of your calls, you’re missing not only cold leads from potential clients, but also warm leads from other attorneys. Expand Your Horizon: Maintaining a Growth Mindset Being a good lawyer isn’t just about the time you have in the game — it’s about what you do with that time. Przemek Lubecki of Morris Bart Personal Injury Lawyers has dedicated himself to constantly growing, improving, and honing his skills. This week he shares with us what routines he uses to stay at his best, inside and outside the courtroom. Przemek has personally tried over 100 jury trials. In fact, in 2006, he was recognized by the Cook County Jury Verdict Reporter for having tried the second-most jury trials of any lawyer in Illinois. He began his legal career in Chicago working in defense litigation before moving to New Orleans and switching to personal injury law. On this week’s episode, we talk to Przemek about the methods he uses to maintain a growth mindset in both his personal and professional lives. He tells us about his hobby of competition shooting and how it teaches him skills that transfer to the courtroom. And we delve into some of the wellness routines he uses to keep his mind and body at their best. Key takeaways Create a growth mindset. Simply having years of experience as a lawyer isn’t enough to keep you at the top of the game. It’s important to actively cultivate a mindset of growth and continuous improvement. Develop strong skills, strategies, and confidence. Many of the same characteristics that help Przemek win shooting competitions also help him find success in the courtroom. You need a solid strategy, the skills to put that strategy into action, and the confidence to sell a jury on what you’re telling them. Set up wellness routines. Finding wellness routines that fit with your needs and lifestyle can help you be healthier mentally and physically. Getting quality sleep, reducing your stress levels, and being more aware of your body’s natural rhythms can keep you at your best. Take the cases no one wants, make network connections, and put in the time working cases. Nothing can make up for a strong work ethic and a willingness to push through difficult situations when you’re establishing a legal career. Make friends with other lawyers. Don’t view your competitors as your enemies — they can be some of your greatest resources. Make friends with the other lawyers in your field, and lean on them when you need advice. Trust the process. Leaving a steady, high-paying job at a successful law firm to strike out on your own may seem like a risky decision. But that’s exactly what Mark Bratt did. One year later, The Bratt Law Firm is making over a million dollars, and his work-life balance is better than ever before. Mark has had an impressive career, winning over $150 million for his clients, being named a National Trial Lawyers Top 100 Trial Lawyer, and being nominated for the Los Angeles Trial Lawyer of the Year award. The Bratt Law Firm has recovered settlements of over $27 million in its first year, and this is just the beginning. This week, Mark sits down with us to talk about why he left his job at a large law firm and how he’s found such success in his first year of sole proprietorship. We dig into the importance of work-life balance, the power of honesty and integrity, and how to push past fear and create a life you love. Key takeaways: Listen to your inner voice. Making change is scary, but you have to listen to your inner voice, not just the voice of fear. Be honest and vulnerable. If you aren’t being honest and transparent with your family, your friends, your clients, and yourself, you’re going to lose. Build a balanced life. Success in your career is wonderful, but it can’t come at the cost of happiness in your personal life. You have to build a life that allows you to meet both of those needs. In the past two decades, Glen has grown a firm that has some of the best brand recognition in the country. Glen has built a national reputation and a firm that has recovered over a billion dollars for their clients in the last five years alone. He has worked as a teamster and a garbage man to gain a better understanding of the people he represents. And today, he prides himself on fighting for “the little guys” in personal injury cases. On this episode of Tip the Scales, Glen talks to us about what exactly makes Lerner and Rowe so successful and how they’re navigating the challenges of a post-COVID world. Delegate tasks to people you trust, and trust that everything will work out okay in the end. Learning to go with the flow can help you find a healthier, happier mindset in your life. Investing your money can be a scary, overwhelming, and confusing process. How do you create an investment plan that will not only support you through your golden years, but also give your children and grandchildren a strong inheritance? These are exactly the questions Rick Ferri has been answering for over thirty years, and some of his answers may surprise you. Rick has worked in a variety of finance roles, from his beginnings as a stockbroker in a large Wall Street firm to running an industry-changing private advisory firm. At its peak, Rick’s firm was managing over $1.5 billion in assets and had a revolutionary low rate of just 0.25 percent per year. Today, he offers as-needed financial advice to families looking for the best way to build a more secure future. We sit down with Rick this week to talk about what really goes into making good investment decisions. He explains the machine that drives market fluctuations, the importance of a diversified portfolio, and the simple approach to investing that gives you the best chance at a solid return. Cut through the media hysterics and bad counsel from unethical financial advisors to discover how you can take back control of your money and your future. Key Takeaways Advocate for your own interests. Just because someone says they’re a fiduciary doesn’t necessarily mean they’re acting in your best interests. It’s best to learn all you can and be proactive in making sure you’re getting the best investment setup for you. Good investing is not sexy. It’s incredibly difficult for even the most educated financial advisors to outperform the stock market. You have a better chance of success if you invest in a solid, diversified portfolio and give it lots of time to grow. Investing in the stock market is betting on capitalism. As long as we continue to believe capitalism works and that it’s going to persist as the global financial system, the stock market is going to continue to grow and thrive. Running a successful law firm means always being willing to adapt, explore new technology, and make bold moves. Yosi Yahoudi has built a successful firm following these principles, even recently implementing an exciting new piece of software called Levitate. His firm has also switched case management software multiple times as their needs have changed. Yosi began his law firm, J&Y Law, in the middle of the 2009 recession and has grown it to a successful practice nearly fifteen years later. J&Y has recovered millions of dollars for their clients, and Yosi has become a lifetime member of the Multi-Million Dollar Advocates Forum, as well as a member of the National Trial Lawyers Top 40 Under 40. This week, we dive into the features you can get with software like Levitate or Litify. We talk about whether AI is really going to replace humans in the content creation space and how you can be confident in taking daring action for the future of your firm. Key Takeaways AI has potential, but it’s not a silver bullet. Programs like Chat GPT may show promise for eventually creating high-quality legal content, but the field is still very new. For the time being, human-generated content remains the gold standard. Don’t be afraid to make bold moves. Investing in your firm, particularly in advertising, is scary, but it’s well worth the risk. Figure out what works for your firm, and then be bold in taking the leap and putting your firm out there. The right software can transform your client experience. Finding your footing in your legal career can take time, but it’s an important process. Over the course of his career, Greyson Goody has grown from a rookie attorney with The Simon Law Group to one of the most respected trial lawyers in California. One of his secrets for success is prioritizing his physical, mental, and emotional health. Greyson is now a partner at The Simon Law Group and at Goody Law Group. He has won over $40 million in jury verdicts and was named a Super Lawyers Rising Star in 2018, 2019, and 2020. This week, Greyson talks to us about the qualities that make him a great trial lawyer and how he found his footing in the legal world. He also gave us a view into how he decompresses after a case and why it’s so important for young lawyers to build a habit of relaxation into their routines. Key takeaways: Be honest. Being transparent and owning the negative aspects of a case will help you earn trust with a jury and get a better result. Make relaxation a habit. Working all the time will just leave you burned out and unhealthy. You need to set aside time to decompress and do things you love. Learn to trust yourself. It's easy to think that becoming a successful lawyer requires sacrificing personal life in favor of billing more hours. Having time for family isn't possible between appearances, conferences, and an ever-growing caseload. But as Sevy Fisher, partner and trial attorney at the Simon Law Group, explains, creating your desired life is possible. Getting there requires a bit of leg work. His advice includes finding a firm that shares your values, a willingness to trust the team, tapping into empathy, and letting go as critical to a happier life in law. As well as tips for finding a work-life balance, hear why Sevy believes empathy is his strongest tool in the courtroom. He walks us through high-low agreements and why building relationships with the opposition is good business. Key takeaways: Take calculated risks. While in trial, it can feel like all of the burdens fall on the shoulders of the most senior attorney. The desire to control every aspect of the case is a natural response. However, a team that is not allowed to take risks and possibly fail will never grow. Set boundaries. An attorney can not be everywhere all at once, but it is possible to carve out time for what matters most. Be present. Create win-win relationships. Make the other side look good. The opposing council will remember you and think of you as both reasonable and capable of striking a deal with.
